Prebook Homes operates as a property management software platform and tenant-finding service that helps landlords and property managers distribute their rental properties across multiple marketing channels including Rightmove, Zoopla, Facebook Marketplace, Gumtree, and other property portals.
1. DEFINITIONS
- “Prebook Homes,” “we,” “our,” or “us” refers to Prebook Homes Ltd, a company registered in England and Wales.
- “Platform” refers to the Prebook Homes website, mobile applications, and services.
- “Property Lister,” “you,” or “your” refers to landlords, property managers, or authorized agents who list properties on our Platform.
- “Listing” refers to a property advertisement created and published through our Platform.
- “Subscription Plan” refers to the various service tiers offered (Free, Starter, Growth, Professional, or Agency).
- “External Platforms” refers to third-party property portals where we distribute your listings.
- “Rent2Credit” refers to our separate tenant credit-building service.
2. PROPERTY LISTING SERVICES
2.1 Service Description
Prebook Homes provides property listing aggregation and distribution services, allowing you to:
- Create property listings on our Platform
- Automatically distribute listings to multiple External Platforms
- Manage inquiries and applications through our system
- Access analytics and performance data
- Utilize optional additional services
We operate as a property management software platform where landlords use our technology to manage listings and find suitable tenants. All rental transactions and agreements remain directly between landlords and tenants.
2.2 Subscription Plans
We offer various subscription tiers with different features and listing limits:
- Free Tier: 1 property listing
- Starter Tier (£30/month): 5 property listings
- Growth Tier (£60/month): 10 property listings
- Professional Tier (£100/month): 20 property listings
- Agency Tier (£299/month): 70 property listings
All plans include basic listing distribution, tenant screening tools, analytics, and customer support.
2.3 Additional Services
Optional services may include:
- Featured listing placement (£10/week)
- External platform advertising fees (variable)
- Enhanced tenant screening (£15/tenant)
- Professional photography services
- Virtual tour creation
3. PROPERTY LISTER OBLIGATIONS
3.1 Accurate Information
You must:
- Provide accurate, complete, and up-to-date property information
- Ensure all property descriptions, photographs, and details are truthful
- Update listings promptly when circumstances change
- Verify you have authority to list the property
3.2 Legal Compliance
You warrant that:
- You hold all necessary rights, licenses, and permissions to list the property
- The property complies with all applicable housing laws and regulations
- You have all required safety certificates and documentation
- You comply with fair housing and anti-discrimination laws
3.3 Property Standards
Properties listed must:
- Meet minimum habitability standards
- Comply with local licensing requirements
- Have valid Energy Performance Certificates where required
- Meet fire safety and gas safety regulations
3.4 Tenant Relations
You agree to:
- Respond to legitimate tenant inquiries promptly
- Conduct fair and lawful tenant selection processes
- Honor agreed rental terms and conditions
- Maintain the property in reasonable condition
4. FEES AND PAYMENTS
4.1 Subscription Fees
- Monthly subscription fees are charged in advance
- All fees are non-refundable unless otherwise specified
- Price changes will be communicated 30 days in advance
- Failed payments may result in service suspension
4.2 Additional Service Fees
- Featured listings: £10 per week
- External platform fees: Variable based on platform requirements
- Enhanced services: As specified at time of purchase
4.3 Payment Terms
- Subscription fees are due monthly in advance
- Commission fees are charged upon successful letting
- All fees are exclusive of VAT where applicable
- Payment disputes must be raised within 30 days
5. PLATFORM USAGE RULES
5.1 Acceptable Use
You agree to:
- Use the Platform only for legitimate property listing purposes
- Maintain accurate and current account information
- Respect intellectual property rights
- Comply with all applicable laws and regulations
5.2 Prohibited Activities
You must not:
- Post false, misleading, or fraudulent listings
- Use the Platform for any illegal purposes
- Discriminate against potential tenants on protected grounds
- Attempt to circumvent our systems or security measures
- Harvest or collect user data without authorization
- Post content that violates third-party rights
5.3 Content Standards
All listing content must:
- Be accurate and truthful
- Comply with advertising standards
- Not contain offensive or discriminatory language
- Include all material terms and conditions
- Comply with fair trading requirements
6. INTELLECTUAL PROPERTY
6.1 Platform Content
The Prebook Homes Platform, including software, design, and content, is protected by intellectual property laws and owned by or licensed to Prebook Homes.
6.2 Your Content
By uploading property information, photos, or other content, you grant us a non-exclusive license to:
- Display your content on our Platform
- Distribute your content to External Platforms
- Use your content for marketing our services (with your consent)
- Process and modify content for technical compatibility
6.3 Third-Party Content
You represent that all content you provide does not infringe third-party rights and that you have necessary permissions for any photographs, descriptions, or materials.
7. EXTERNAL PLATFORM DISTRIBUTION
7.1 Third-Party Relationships
- We distribute your listings to External Platforms as a service
- You remain responsible for compliance with each platform’s terms
- We cannot guarantee acceptance or continued listing on External Platforms
- External Platform policies and fees may change independently
7.2 External Platform Fees
- Some External Platforms charge additional fees
- These fees are separate from our subscription charges
- You are responsible for any direct relationships with External Platforms
- We may facilitate payment but are not liable for External Platform billing
8. DATA PROTECTION AND PRIVACY
8.1 Data Processing
We process your personal data in accordance with our Privacy Policy and applicable data protection laws, including UK GDPR and the Data Protection Act 2018.
8.2 Tenant Data
When we collect tenant inquiry data:
- We act as joint data controllers with you
- You must have appropriate privacy notices for tenants
- Tenant data is used only for legitimate letting purposes
- Both parties must comply with data protection obligations
8.3 Data Security
We implement appropriate security measures to protect your data, but you remain responsible for:

9. RENT2CREDIT SERVICE
9.1 Separate Service
Rent2Credit is a separate subscription service for tenants that helps build credit history through rent payment verification. This service:
- Is independent of our property listing services
- Requires separate tenant consent and subscription
- May involve us contacting you for payment verification
- Is governed by separate terms and conditions
9.2 Verification Cooperation
If you have tenants using Rent2Credit, you agree to:
- Respond reasonably to verification requests
- Provide accurate payment confirmation when requested
- Maintain reasonable records of rental payments
10. LIABILITY AND DISCLAIMERS
10.1 Platform Availability
We strive to maintain Platform availability but do not guarantee uninterrupted service. We are not liable for temporary outages or technical issues.
10.2 Listing Distribution
While we use reasonable efforts to distribute listings to External Platforms, we cannot guarantee:
- Acceptance by all External Platforms
- Continued listing placement
- Response rates or inquiry quality
- Successful lettings
10.3 Limitation of Liability
To the maximum extent permitted by law:
- We disclaim all warranties except as required by law
- Our liability is limited to the fees paid by you in the 12 months preceding any claim
- We are not liable for indirect, consequential, or punitive damages
- We are not responsible for tenant default, property damage, or rental disputes
10.4 Your Responsibilities
You acknowledge that:
- Property listing and letting carry inherent risks
- You are responsible for tenant screening and selection
- You must comply with all applicable landlord obligations
- We operate as a property management software platform and tenant-finding service only. We do not handle customer money, collect rent payments, or manage properties directly.
11. COMPLAINTS AND DISPUTE RESOLUTION
11.1 Internal Complaints
If you have a complaint:
- Contact our customer service team initially
- We will investigate and respond within 8 weeks
- Serious issues will be escalated to senior management
11.2 Alternative Dispute Resolution
For unresolved disputes, we are members of The Property Ombudsman scheme, providing free, independent dispute resolution services.
11.3 Legal Jurisdiction
These Terms are governed by English law, and any legal proceedings must be brought in the courts of England and Wales.
12. TERMINATION
12.1 Termination by You
You may terminate your account at any time by:
- Cancelling your subscription through your account settings
- Providing written notice to our customer service team
- Termination is effective at the end of your current billing period
12.2 Termination by Us
We may terminate or suspend your account if you:
- Breach these Terms materially
- Engage in fraudulent or illegal activity
- Fail to pay required fees
- Violate External Platform terms repeatedly
12.3 Effects of Termination
Upon termination:
- Your listings will be removed from our Platform and External Platforms
- You retain access to account data for 30 days
- Outstanding fees remain payable
- These Terms survive termination where necessary
13. CHANGES TO TERMS
We may modify these Terms periodically. Material changes will be communicated at least 30 days in advance through:
- Email notification to your registered address
- Prominent notice on our Platform
- Updated version posted on our website
Continued use after changes constitutes acceptance of the modified Terms.
14. GENERAL PROVISIONS
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and Prebook Homes.
