INTRODUCTION

Welcome to Prebook Homes! These Terms and Conditions (“Terms”) govern your access to and use of the Prebook Homes website, mobile applications, and services (collectively, the “Platform”) as a tenant or prospective tenant.

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

1. DEFINITIONS

In these Terms, the following definitions apply:

  • “Prebook Homes,” “we,” “our,” or “us” refers to Prebook Homes Ltd, a company registered in England and Wales.
  • “Platform” refers to the Prebook Homes website, mobile applications, and services.
  • “Customer,” “Tenant,” “you,” or “your” refers to individuals seeking rental properties or using our Rent2Credit service.
  • “Landlord” refers to property owners or agents who list properties on our Platform.
  • “Rent2Credit” refers to our credit-building service that reports rent payments to credit reference agencies.
  • “Property Listing” refers to rental properties advertised through our Platform.

2. OUR SERVICES

2.1 Property Search Platform

We operate a property management software platform and tenant-finding service where:

  • Landlords use our software to manage their property listings
  • We distribute listings across multiple property portals including Rightmove, social media platforms, classified sites, and partner networks
  • We facilitate tenant inquiries and communication
  • We charge landlords fees for platform usage and successful tenant placement
  • All rental transactions remain directly between landlords and tenants

Important: We are a platform service only. All rental agreements are directly between you and the landlord.

2.2 Rent2Credit Service

Our Rent2Credit service helps tenants build credit history by:

  • Verifying your rent payments through monthly landlord contact
  • Reporting verified payments to major credit reference agencies
  • Providing a subscription service for £5 per month
  • Operating independently of any rental transactions

3. PROPERTY SEARCH AND BOOKING

3.1 Property Information

  • Property listings are provided by landlords and distributed across multiple platforms
  • We aim to ensure accuracy but cannot guarantee all information is current or complete
  • Property availability, pricing, and terms are subject to landlord confirmation
  • Virtual viewings and property details are provided for information purposes
  • Landlords pay monthly subscription fees for platform listing services and tenant-finding capabilities

3.2 Initial Contact and Inquiries

  • We facilitate initial contact between tenants and landlords
  • All viewing arrangements are made directly with landlords
  • We do not conduct property viewings on behalf of landlords
  • Response times depend on individual landlord availability

3.3 No Rental Transactions

Important: We do not:

  • Handle any customer money or funds
  • Collect rent payments or security deposits
  • Hold money on behalf of landlords or tenants
  • Process any financial transactions between parties
  • Act as traditional letting agents

We are a software platform and tenant-finding service only. All rental transactions, agreements, and payments are conducted directly between you and the landlord.

4. RENT2CREDIT SERVICE

4.1 Service Description

Rent2Credit is a monthly subscription service (£5/month) that:

  • Verifies your rent payments through landlord confirmation
  • Reports verified payments to credit reference agencies
  • Helps build your credit history through consistent rent payment records

4.2 Enrollment Requirements

To use Rent2Credit, you must:

  • Provide a current tenancy agreement
  • Supply landlord contact information
  • Authorize us to contact your landlord monthly
  • Maintain an active subscription

4.3 Verification Process

  • We contact your landlord monthly to verify rent payment
  • Verification is based on landlord confirmation only
  • We do not access your bank accounts or payment methods
  • Reporting depends on successful landlord verification

4.4 Credit Reporting

  • Verified payments are reported to major UK credit reference agencies
  • Both positive and negative payment history may be reported
  • Credit reporting continues while your subscription is active
  • You can cancel reporting by ending your subscription

4.5 Subscription Terms

  • Monthly subscription of £5, charged in advance
  • 14-day cooling-off period from subscription start
  • Cancel anytime with immediate effect
  • No refunds for partial months
  • Automatic renewal unless cancelled

5. PAYMENT TERMS (RENT2CREDIT ONLY)

5.1 Subscription Payments

  • Rent2Credit subscription: £5 per month
  • Payments processed through secure third-party providers
  • Automatic billing unless cancelled
  • Price changes require 30 days written notice

5.2 Cancellation and Refunds

  • Cancel your Rent2Credit subscription anytime
  • Cancellation takes effect immediately
  • No refunds for current billing period
  • Data retention continues as per our Privacy Policy

6. USER OBLIGATIONS

6.1 Account Information

You agree to:

  • Provide accurate and current information
  • Maintain the security of your account credentials
  • Notify us immediately of unauthorized access
  • Update information when circumstances change

6.2 Platform Usage

You agree to:

  • Use the Platform only for lawful purposes
  • Respect intellectual property rights
  • Not interfere with Platform operations
  • Comply with all applicable laws and regulations

6.3 Rent2Credit Specific Obligations

For Rent2Credit service, you agree to:

  • Provide accurate tenancy and landlord information
  • Authorize landlord contact for verification purposes
  • Notify us of any changes to your rental arrangements
  • Ensure landlord contact information remains current

7. LANDLORD RELATIONSHIPS

7.1 Direct Relationship

  • All rental relationships are directly between you and landlords
  • We are not party to any tenancy agreements
  • We do not guarantee landlord responsiveness or property quality
  • Disputes should be resolved directly with landlords

7.2 Platform Facilitation

  • We provide a software platform for property discovery and tenant-finding services
  • Initial contact facilitation only
  • No endorsement of specific landlords or properties
  • Due diligence is your responsibility

8. DATA PROTECTION AND PRIVACY

8.1 Personal Information

  • We collect and process personal data as described in our Privacy Policy
  • Rent2Credit requires additional data for credit reporting purposes
  • Landlord contact is necessary for verification services
  • Data retention periods vary by service type

8.2 Credit Reporting Consent

By subscribing to Rent2Credit, you consent to:

  • Monthly landlord contact for verification
  • Sharing payment information with credit reference agencies
  • Data processing for credit reporting purposes
  • Continued reporting until subscription cancellation

9. INTELLECTUAL PROPERTY

9.1 Platform Content

  • All Platform content is owned by or licensed to Prebook Homes
  • Property listings remain the intellectual property of respective landlords
  • You may not reproduce, distribute, or modify Platform content
  • Limited license granted for personal, non-commercial use

10. LIMITATION OF LIABILITY

10.1 Platform Limitations

We do not guarantee:

  • Property availability or accuracy of listings
  • Landlord responsiveness or reliability
  • Successful rental outcomes
  • Continuous Platform availability

10.2 Rent2Credit Limitations

For Rent2Credit service, we do not guarantee:

  • Landlord cooperation with verification
  • Specific credit score improvements
  • Acceptance by all credit reference agencies
  • Particular timeframes for credit impact

10.3 Liability Exclusions

To the maximum extent permitted by law:

  • We exclude liability for indirect or consequential damages
  • Our total liability is limited to amounts paid to us
  • We are not liable for landlord actions or omissions
  • Property transactions are entirely at your own risk

11. COMPLAINTS AND DISPUTE RESOLUTION

11.1 Internal Complaints

  • Contact us first for any complaints or concerns
  • We aim to respond within 8 weeks
  • Complaints can be submitted via email or our contact form
  • We maintain records of all complaints and resolutions

11.2 Alternative Dispute Resolution

For unresolved complaints:

  • Property-related issues: Contact The Property Ombudsman
  • General service complaints: Seek independent mediation
  • Legal disputes: Subject to English courts jurisdiction

12. TERMINATION

12.1 Account Termination

You may terminate your account at any time by:

  • Contacting our customer service
  • Following online account closure procedures
  • Cancelling any active subscriptions

12.2 Service Termination by Us

We may terminate or suspend services if:

  • Terms are breached
  • Fraudulent activity is suspected
  • Legal compliance requires termination
  • Reasonable notice will be provided where possible

13. CHANGES TO TERMS

14. GENERAL PROVISIONS

These Terms, together with our Privacy Policy, constitute the complete agreement between you and Prebook Homes.

If any provision is found invalid, the remaining Terms continue in full effect.
